Terms of Service

The rules of the road when using Callsy's AI voice calling platform.

Welcome to Callsy.ai. By using our Services you agree to comply with and be bound by these Terms. If you do not agree, do not use the Services.

1. Definitions

  • Callsy / we / us: Callsy AI OÜ, Republic of Estonia.
  • Merchant / you: the business or individual that registers for a Callsy account or installs a Callsy integration.
  • Services: the Callsy platform, the Shopify app, the REST API, the MCP server, and related integrations.
  • End User: any natural person the Merchant contacts using the Services.
  • AI Agent: an automated voice agent configured via the Services, or an external AI model (e.g. Claude, GPT) that invokes Callsy via MCP.

2. Eligibility and account

To use Callsy you must:

  • Be at least 18 years old
  • Have a valid Shopify account or be approved for direct API / MCP access
  • Provide accurate, complete registration information
  • Keep your credentials and API keys confidential — you are responsible for all activity under your account

3. AI disclosure (EU AI Act)

The Merchant acknowledges that the Services use artificial intelligence to generate voice responses. In compliance with the EU AI Act, the Merchant agrees that all AI Agents configured via the Service shall be programmed to disclose their non-human nature to the End User at the commencement of the call. The Merchant shall not override, suppress, or delay this disclosure.

4. The Services

Callsy provides, depending on the Merchant’s plan and integration:

  • AI voice agents that place outbound calls (e.g. cart recovery, meeting booking, reservations, lead qualification)
  • A REST API and MCP server that let the Merchant, or the Merchant’s chosen AI agent, programmatically create agents, manage contacts, trigger calls, and read results
  • Workflow automation with multi-step graphs, branches, retries, and scheduled nodes
  • Transcripts, sentiment analysis, and analytics for every call

5. Merchant responsibilities

As a Merchant, you agree to:

  • Provide accurate and current product, pricing, and contact information
  • Comply with all applicable laws and regulations in every market you contact, including telemarketing, unsolicited-communication, data protection, and consumer-protection laws
  • Obtain and maintain all necessary lawful bases and consents before triggering calls via Callsy
  • Keep your agent scripts and guardrails accurate and not misleading
  • Not use the Services for unlawful, fraudulent, harassing, defamatory, or otherwise harmful purposes

6. Unsolicited communication

Merchants are solely responsible for ensuring that any communication with their customers, including but not limited to calls made by an AI agent using Callsy, complies with all applicable laws and regulations regarding unsolicited communication. This includes obtaining necessary consents and providing any required notices. Callsy bears no responsibility for claims, damages, or legal actions arising from unsolicited communications sent using the Services. Merchants assume all legal implications and liabilities.

7. Fair use and rate limits

Callsy may enforce reasonable rate limits on API calls, MCP tool invocations, and outbound call volume to protect the integrity of the platform. We will communicate material limits in advance where practical.

8. Intellectual property

All content on Callsy.ai and within the Services — including text, graphics, website name, code, images, and logos — is the intellectual property of Callsy AI OÜ or its licensors and is protected by copyright and trademark law. Unauthorized reproduction, distribution, display, or transmission is prohibited without explicit authorization.

9. Customer data

By using the Services you authorise Callsy to access and process End-User Data and Merchant Data for the purpose of providing the Services, as further described in our Privacy Policy and Data Processing Agreement.

10. Data Processing Addendum

By installing or using Callsy, the Merchant (Controller) accepts and enters into the Data Processing Agreement (DPA) incorporated herein by reference. The DPA becomes effective automatically upon installation or use. No additional signatures are required under GDPR Article 28.

11. Termination

We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, to us, or to third parties, or for any other reason allowed by law. You may cancel at any time from within your dashboard.

12. Limitation of liability

To the maximum extent permitted by law, Callsy.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your use or inability to use the Services; (b) unauthorized access to or alteration of your transmissions or data; (c) transmission interruptions, bugs, or viruses; or (d) claims arising from unsolicited communications made using the Services. Our aggregate liability in any 12-month period is capped at the amounts paid by the Merchant to Callsy in that period.

13. Indemnification

You agree to indemnify and hold Callsy.ai and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any third-party claims arising from your use of the Services, your violation of these Terms, your violation of any rights of another, or any claims, damages, or legal actions arising from unsolicited communications conducted by you using the Services.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of any significant changes by posting the updated Terms on our website and, if necessary, through other communication channels. Continued use after updates constitutes acceptance of the new Terms.

15. Governing law

These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law principles.
